Did you enter a maze anytime? The income tax department in India is confusing, like a maze, especially the tax levied on winnings from casinos. Like the nature of naughty toddlers, taxes are often changeable but hardly ever forgotten. The Income Tax Act 1961, which came into force on April 1, 1962, states that any income received as winnings from lotteries, races, card games, etc., are chargeable. Don't worry; the neighbors do not assess it. These winnings are all taxed to the Income tax of India. Section 115BB of the IT Act acts as a separate taxing mechanism for these winnings.

Newly Introduced Provisions on Taxations on Winnings

If you put the Indian Income Tax department in charge of the Thar Desert for 5 years, a shortage of sand would surely be noticed. Considering the demand for online games and their recent popularity, a proposal on behalf of the Legislature, vide Finance Bill, 2023, is given. It prescribes specific provisions regarding tax deduction under Section 194 BA, and the taxability of online games under Section 115 BBJ was noted.

Gamblers hop to different casino sites or land-based casinos with an urge to play real money games because they come with good payouts and winnings. Aren't they sound lucrative? Yes obviously. But do you know these winnings are very much taxable? Do you know how the winnings from gambling and betting at online or land-based casinos are being taxed in India? A country like India has allocated a 30% tax deduction from the winnings. The gambling companies will deduct the taxes on every win the player earns before paying them in India.

The gambler is responsible for deducting the amount of money from winnings when he strives to withdraw them from the user account registered with an online or offline gambling intermediary. Else, it is prompted at the end of the financial year or FY: Section 194 BA provides for TDS on net winnings from online games from the gamblers. Section 194B asserts a threshold of INR 10,000 applicable on a financial year basis to entreat the tax deduction liability.

Newly Introduced Provisions on Taxations on Winnings

Tax Charged from Different Sources of Winnings from Casino Games

Conceptualizing that the incomes earned from legal or illegal sources are put into income tax slabs, many gamblers agree that tax exemptions are provided when you play a social casino without real money. But it is noteworthy that all incomes from real money games are always taxed. Now this enters a debate between the game of skill and the game of chance, but ignoring it, the Indian government has asked the income tax authorities to implement the taxes to be deducted under Sections 194BA and 115BBJ.

Do you know what Section 194BA is stated in the Circular No. 5 of 2023, issued by CBDT, elaborates? This section states the ways to control tax payments on winnings. Here comes a big smile on gamblers' faces because Circular No. 5 of 2023, issued by CBDT, traces the computation of net winnings through different user accounts at different casino destinations, stating incomes from bonuses and incentives, cash relaxation from insignificant withdrawals, valuable winnings, etc.

For example, while playing online poker, if you manage to make any winnings, you have to pay tax based on the net amount of your winnings. If TDS is not deducted instantly from your winnings, you can file for income tax within 30 days after the winnings are in your account. Just like Mr. Minto has received INR 30,000 from gambling, he has to pay 30% of this amount, including the cess; a 31.4% tax will be deducted from his account for INR 30000.

Therefore, the said winnings of Mr. Minto from online casino games played on land-based casinos were hitherto taxable on account of Section 56(2) (ib). This amendment prescribes that income shall be taxable under the head' Income from other sources. This amendment also applies to the winnings from online games that would also fall under the head of IFOS.

Have you checked your winning amount? Yes, if it is more than INR 50 lakh, a surcharge of around 10% will be levied. It will be applicable over the normal winning rate. This surcharge will be 33%, which excludes the cess. After the cess is included, the total tax will be 34.32%.

The enhancement in income tax is causing a catastrophic burden on gamblers. Is it true? At some point, gamblers may get a severe blow, but on the other hand, the unlimited winnings from casinos would withstand paying that extra cost to the government.

Do these Laws, Amendments, and Provisions Remain the Same, or They Alter in Situations?

The legal regime of gambling is a confusing matrix, as are its taxation implications and amendments on winnings like on jackpot guru casino. It is in the hands of the central and laws that predate the tax amendments and make changes depending on the situation with an ultimate motive of enhancing the gambling sector and earning income for the economic betterment of the country. Barring a few exceptions, the game of skills is excluded from gambling taxation, including the social video games played for fun and not for real cash.

But the same treatment cannot apply to horse racing; betting on various sports with zero elements of skill is intimated while gambling at land-based or online casinos to win real money. What do the gambling operators think of this taxation implemented on winnings? An increase in taxation on winnings in the jurisdiction would merely have a catastrophic impact on the gambling industry because the eagerness to gamble would not easily go away from gamblers' hearts, as Indians are very fond of gambling. Their earnings allure them to stay connected with the gambling dens all the time.

Do you want recognition as a taxpayer of your jurisdiction? If yes, increase your country's revenue by engaging yourself at the best casinos in India. Is your gambling urge rising high? Stride ahead, where the offerings are lucrative, affixed with magnificent services to make you earn good incomes from winnings.

Government lotteries in India 2024

Lotteries and other forms of gambling have a colourful history in India. While lotteries are regulated under a central umbrella, how they are managed is subject to the discretion of state governments. However, the growing popularity of lotteries saw the Lotteries (Regulation) Act of 1998 and the Lotteries (Regulation) Rules 2010 introduced, which established detailed standards for the governments to follow.

Currently, lottery games are legal in 13 Indian states, though anyone of legal gambling age in India can buy international lottery tickets online. The ticket prices and prize pools of government lotteries in India vary depending on the lottery scheme and state in which it is regulated. Tickets for weekly draws begin at modest prices like ₹2 or ₹5 and increase for bumper draws and special schemes.

Beyond chance: where gambling and Vedic astrology meet

Whether you like it or not, luck plays a crucial role in gambling. And while many would argue that it’s an unreliable force, for many Indians, the ancient tradition of Vedic astrology offers a way to understand how luck works in the universe and how one could potentially manipulate it to work in one’s favour.

Vedic astrology (known as Jyotish in Sanskrit) is the practice of studying planetary positions, celestial influences, and karmic patterns to understand how these influence and shape human lives and destinies.

When it comes to gambling, some Indians look to Vedic astrology to boost their chances of success. By analysing astrological charts and horoscopes, and identifying cosmic connections, gamblers seek to find the most advantageous time to gamble, looking for lucky combinations of numbers, or even charms and rituals to help improve their chances.

Let’s look at this more closely:

Planetary configurations

"Muhurtha", an essential principle of Vedic astrology, indicates the opportune time to partake in certain activities based on planetary configurations. It also highlights when best to avoid certain activities. So, in the case of gambling, a player would wait for a favourable Muhurtha to maximise their chances of success.

Presence of the planets

Vedic astrology focuses on nine “grahas”, which are collectively referred to as the “navagrahas” (nava meaning nine). They include the sun (Surya), moon (Chandra), Mars (Mangala), Mercury (Budha), Jupiter (Brihaspati), Venus (Shukra), Saturn (Shani), Rahu (north node of the moon), and Ketu (south node of the moon). According to Vedic astrology, the planet Venus offers luxury and Jupiter provides immense wealth. A conjunction of Jupiter and Venus unafflicted with the moon is therefore said to bring good luck and prosperity.

Birth charts

Many Indians strongly believe in analysing their birth chart in every aspect of their life. This comes from Vedic astrology, which argues that the alignment of different celestial bodies at your birth can provide invaluable insights. In the case of betting, it could highlight a person’s gambling and risk-taking tendencies and subsequent strategies they could employ to maximise their chances of winning, translating into profits and success.

Astrology and numerology

Hindus love to rely on their favourite numbers, particularly when it comes to gambling, and generally prefer odd numbers over even. Seven and eight are considered auspicious numbers, representing success and prosperity. Many Hindus also use these numbers at the time of Diwali when, in some houses, gambling is a ritual. Another lucky sequence of numbers in Hinduism is 786, representing the Trinity of Brahma, Vishnu, and Shiva.

Good luck charms: superstitions or divine blessings?

In casinos, we often hear phrases like good luck and good fortune. Not surprising, really, given how the majority of casino games are based primarily on chance, though some would claim that success is also down to mathematics and algorithms.

In any case, luck plays a crucial role in gambling, and many gamblers will have their own rituals they perform before games or even lucky charms they carry to improve their chances of winning.

Hinduism, one of the oldest practising religions in the world, believes in positive and negative energy, which could define your moves and outcomes. Furthermore, there are several ways one can channel these energies, whether through prayer or certain objects such as charms or symbols. We shall discuss these in more detail below.
